By visiting, using and/or accessing the Website and any of the features made available to you by the Website, you hereby agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you are not authorized by the United States Marine Corps to access and/or use any portion of the Website. These Terms and Conditions shall remain in full force and effect while you use or access the Website. We may, in our sole discretion, modify or revise these Terms and Conditions at any time, and by continuing to access the Website after such modifications or revisions are posted, you agree to be bound by such modifications or revisions.
Nothing in these Terms and Conditions shall be deemed to confer any rights or benefits on you or any third party except as provided by law.
The purpose of the Site is to provide information on the Marine Corps and recruitment opportunities and to allow you to interact with those who may influence prospective recruits through our Connect and Share program (the "Program").
You may use this Website only for your personal and non-commercial purposes and subject to these Terms and Conditions, all applicable laws, rules and regulations and any agreements or terms with third parties to which you are subject. You may not use this Website for commercial purposes, such as to promote a product or service, without our prior written consent.
By accessing and using the Website, you represent and warrant that you are at least 17 years old (or 16 years old and a junior in high school or equivalent). This Website is not intended for, and we have no intention of collecting personally identifiable information from, any child who is not at least 17 years old (or 16 years old and a junior in high school or equivalent). Additionally, if you are not at least 17 years old (or 16 years old and a junior in high school or equivalent), you are not authorized to register or submit any information to this Website without the explicit consent of your parent or legal guardian. If you live in a state where consent of a parent or guardian is required if you are under the age of 18, you may be required by us to secure such consent prior to your registration with the Website.
You may access the Site without registration, but in order to access certain parts of the Site, such as the Program, you will need to register for an account by providing your first and last name, email address, password, rank, unit and service information, if applicable, and your relationship to the Marine Corps. Your account is for your sole, personal use, you may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. All registration information about you must be truthful, and you may not use aliases or other means to mask your true identity. You hereby authorize us to verify any registration information you submit. You are responsible for the security of your password and will be solely liable for any use or unauthorized use under such password. We may suspend or terminate your account or access at any time with or without notice.
Penalty for False Statements:
The US Criminal Code (Title 18 US Code Section 1001) provides that whoever, in any matter within the jurisdiction of the Government of the United States, knowingly and willfully (1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact; (2) makes any materially false, fictitious, or fraudulent statement or representation; or (3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry, shall be fined or imprisoned not more than 5 years, or both.
The Program: You may share information with other users via the Program by submitting content, such as your biography, advice questions and photographs (collectively, "User Content"). All User Content as well as your name will by default be publicly viewable as part of your profile. You may, however, change your account settings after registration so that your User Content is not publicly viewable. Additionally, you will have the opportunity to provide personal information on the Website for recruitment purposes. By providing such information, you consent to be contacted by a recruiter of the United States Marine Corps.
Acceptable Use Policy ("AUP"):
You are solely responsible for the User Content that you post on the Site or transmit to other users and agree that you will not hold us responsible or liable for any User Content from other users that you access on the Site.
You represent and warrant that the User Content that you submit is original and was created solely by you or, if you are not the creator of the User Content, that you have permission from the copyright owner of the User Content to allow you to submit the User Content to the Site and to use the User Content as otherwise permitted by these Terms and Conditions; (iii) the User Content you submit does not depict or otherwise identify any third party and if the User Content does depict or identify any third party, you have the necessary written permission to use and to allow us to depict or identify such third party in connection with the Site (and that you will provide such written permission to us upon our request); (iv) neither the User Content, nor the use of the User Content by us in accordance with the terms hereof will infringe upon or violate the intellectual property rights, including without limitation, copyright and trademark rights, rights of privacy and/or publicity, or other rights of any other person or entity, or any applicable laws, rules or regulations.
Categories of prohibited User Content below are merely examples ant are not intended to be exhaustive. We will make the sole determination as to whether or not User Content is acceptable for the Site. Without limitation, you agree that you will not post or transmit to other users anything that:
- disparages MCRC, the United States Marine Corps, Department of the Navy, Department of Defense, or any party affiliated with the promotion and administration of the Site;
- contains anything in poor taste or otherwise not in compliance with "Blues Test" standards (The "Blues Test" is a subjective ethical standards test the Marine Corps applies to steer the Marine Corps brand away from objectionable content such as, but not limited to: sexual references, criminal activity, extreme violence, harsh language, political activism and any other potentially controversial subject matter.);
- contains material that is unlawful, classified (as explained in Executive Order 13526-Classified National Security Information), in violation of or contrary to the laws or regulations in any jurisdiction where User Content is created;
- is defamatory, abusive, obscene, profane or offensive;
- infringes or violates another party's intellectual property rights (such as photos or other materials for which you do not have written authority from the owner of such materials to post on the Site);
- violates any party's right of publicity or right of privacy;
- is threatening, harassing or that promotes racism, bigotry or hatred of any kind against any group or individual;
- promotes or encourages violence against a person or damage or destruction of property;
- is inaccurate, false or misleading in any way;
- is illegal or promotes any illegal activities;
- promotes illegal or unauthorized copying of another person's copyrighted work or links to them or providing information to circumvent security measures;
- contains "masked" profanity (i.e., F*@)
- contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
- contains any advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
You understand that when using the Site, you will be exposed to User Content from a variety of sources and that we are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Content.
You may not use spiders, robots, data mining techniques or other automated devices or programs to catalog, download or otherwise reproduce, store or distribute content available on the Site. Further, you may not use any such automated means to manipulate the Site or attempt to exceed the limited authorization and access granted to you under these Terms and Conditions or disrupt the Website or any other user's use of the Website, including, without limitation, via means of overloading, "flooding", "mailbombing" or "crashing" the Site or circumventing security or user authentication measures. You may not frame portions of the Site within another web site or establish links from any other web site to any page of the Site other than the home page. You may not resell use of, or access to, the Site to any third party.
While we encourage you to join the conversation, we still expect you to be respectful of other people and not cross the line and become offensive. If you notice any violation of this AUP or other unacceptable behavior by any user, you should report such activity to us at LifeAsAMarine@marines.com.
We reserve the right, but are not obligated to, monitor all content posted by users on the Site through the use of filters and administrative personnel for compliance with these Terms and Conditions. MCRC reserves the right to monitor and inspect any and all transmissions made through the Site and to block, delete or modify any transmissions in contravention of these Terms and Conditions or that is otherwise objectionable as determined by MCRC in its sole and absolute discretion. In addition, to any other right and remedy that may be available to us, we reserve the right to prevent any user from accessing the Site that has, or may, violate these Terms and Conditions.
You acknowledge that MCRC may not be able to prevent or control content posted to the Site by other users, and that you shall in no event hold MCRC and the United States Marine Corps, Department of the Navy, and Department of Defense liable for the acts of such third parties. In addition, you acknowledge that MCRC has no control over the ultimate use of content posted to the Site (including in connection with the Program) by third parties with access to the Site. MCRC expressly disclaims any liability, and you expressly release MCRC and the United States Marine Corps, Department of the Navy, and Department of Defense from any claim, relating to the content of transmissions on the Site provided by User or other users.
License to User Content:
By submitting User Content to the Website, you hereby grant us a royalty-free, irrevocable, perpetual, non-exclusive sub-licensable license to use, reproduce, modify, publish, create derivative works from, and display such User Content in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed including without limitation, at the Website or any other United States Marine Corps property for any legal purpose, including without limitation, for promoting and marketing MCRC or service in the United States Marine Corps, and its products and services without any compensation or additional notice to you.
